Case Study One.docx BUS 206 Case Study One: Funny Face Southern New Hampshire University BUS 206: Business Law Case Study One: Funny Face In the case of Novelty Now Inc., Chris, Matt, and Ian vs... Donald Margolin, Mr. Margolin who is a successful CEO and public speaker, is suing the defendants in the state of New York. Chris, Matt, and Ian run an online business out of the state of California and they currently contract with the company called Novelty Now Inc. that is based in Florida. The company Funny Face is marketed nationally over the internet, radio, as well as newspapers. To increase the profit margin of Funny Face, the company decided and directed Novelty Now to substitute PYR (a low-cost chemical emulsifier) for the compound in Novelty Now™s original formula, for which PYR is not FDA approved. When the product came out with the new formula, Mr. Margolin bought the product over the internet, that then turned Mr. Margolin™s face a permanently shade of blue. Mr. Margolin and his company Donald Margolin Empire Inc. file a suit alleging negligence and seeking medical costs and compensation for the damage to his face and business reputation. According to Funny Face™s website, it states that anyone buying their product cannot take Chris, Matt, and Ian to court.
