Final Exam LPP 255, Chapters 1 through 8 December 10, 2019, Instructor: Matthew J. Doran The test is open book and open notes. You may use your laptop during the exam. No internet research during... the exam is permitted. Each question is worth 5 points. There are 10 questions for a total of 50 points. Please answer the questions in an answer book. Please write as legibly as possible. You have 120 minutes for the exam. I suggest that you do not spend more than 12 minutes on each question. Each answer should not exceed one page in your answer book. Please make sure to put your name on your answer book. 1. Two sources of law are statutory law and case law (also known as common law). Compare and contrast these sources of law. Give examples. 2. The U. S. Constitution gives the government the authority to do certain things. The first ten amendments to the Constitution limit the authority of the government is certain ways. Explain what this means and give examples. 3. Marbury v. Madison is one of the most important cases in the history of the American legal system. Explain what was decided in the case and why it is such an important case. 4. According to the traditional view, a business has a social responsibility to be as profitable as possible. Under the modern view, a business also has a social responsibility to benefit society. Explain what this means, give examples and include the Enron scandal in your answer. 5. Our system has evolved to grant corporations certain rights and also places responsibilities or liabilities on businesses and corporations. Discuss what this means and give examples. One example is the Hertz case on page 64 in the text. 6. Our system has several forms of Alternative Dispute Resolution (ADR). Why? Explain your answer and give examples. 7. In the Heart of Atlanta Motel, Inc. v. United States, et. al case (1964) on page 125 of the text, the U. S. Supreme Court ruled that the Congress had the power to regulate the hotel with the Civil Rights Act pursuant to Congress’ power under the Commerce Clause. Explain what the Commerce Clause is and how it applied in this case. 8. Should one branch of the government have more powerful than another? What are the benefits associated with a system of government where power is dispersed among three branches of government? 9. In the case of Jeff Roach, et. al. v Howard Stern et. al., the Court dealt with what tort? Do you think the defendant’s behavior could be considered extreme and outrageous? Why? 10.
