The Eighth Amendment plays a role in criminal cases because this amendment ensures that the punishments for crimes are not excessive, cruel, or unusual. This proposal will explain the crime that was committed by the defendant Stu Dents. Justice should be fair even if the suspect has committed an unspeakable crime. Everyone deserves a fair trial matching the punishment to the crime committed. In the following paragraphs, I will analyze the case of State v. Stu Dents, its different sentencing arguments, desired outcome of each punishment, and alternative and intermediate sanctions. Sentencing Proposal In the case of State v. Stu Dents, there are many different crimes committed, each with a different outcome than the others. Each crime has a different punishment that allows justice to be contributed without the sense that justice has been overlooked. The verdict was that the individual committed homicide, kidnapping, drug crimes, and assaulted an officer in the process of the investigation. All these crimes are punishable by law.
