However, under some circumstances such as Bona Fide Occupational Qualification (BFOQ), it allows employers like CAREWARE discriminate qualified individuals. What is BFOQ? 42 U.S. Code § 2000e-2 allows for an employer to discriminate against employees and potential employees "on the basis of his religion, sex, or national origin in those certain instances where religion, sex, or national origin is a bona fide occupational qualification reasonably necessary to the normal operation of that particular business or enterprise." (Law Cornell, n.d.). According to the scenario, CARDWARE did not have genuine BFOQ in its ads because it goes against their motto "you don't have to be an athlete to look and feel like one." Petunia did not get hired because of her figure appearance, and clearly, she qualified for the job but did not get hired. The ad stated, "salesperson experienced in retail sales or marking preferred, energetic, youthful, athletic, and able to "sport" the clothing lines of The Sporty One with style."
