"The Economic Espionage Act punishes theft of trade secrets for pecuniary gain (including the theft from electronic storage) with a penalty of up to 10 years in prison. The Computer Fraud and Abuse Act also consider it a criminal activity" (Doyle, 2016). Although it is sometimes difficult to draw a clear ethical and legal boundary between what is allowed and what is prohibited, it’s hard for me to build anethical case that Pani wasn’t wrong in doing it. He was a long-term employee, and he obviously knew what he was doing. 2. Ethically, does it matter whether Pani was a key author of the taken documents? Why or why not? Although it ethically matters who is the author of taken documents, Pani obtained those documents illegally and breached his work contract which is a crime and is unethical. Confidentiality or nondisclosure agreements protect information and inform signatories of their responsibility to protect, use and disclose information in a responsible and authoritative manner. “The results of one of the statistical surveys conducted in the US showed that in more than 85% of cases of alleged misappropriation of business secrets, someone known by the business secret owner - whether an employee or a business partner - was involved” (Hamidovic, 2016). 3. According to the article, a lot of people do what Pani did. Is that a justification for his action? Explain. Although the general trade secret provisions set out in a work contract or managerial contract are often not sufficient to state with certainty that the employee was aware of the fact that some information should not be disclosed to unauthorized persons, and a lot of people do what Pani did, there is no justification for unethical behaviour. 4. Did Pani have a responsibility to formally end his employment status with Intel before joining AMD, or is it OK for him to be vacationing from Intel while working at AMD? Whose interests need to be considered to answer this question thoroughly? In my opinion, Pani had a responsibility to formally end his employment status with Intel before joining AMD. I am probably subjective because I work in Google and would never work for a rival company while I’m on vacation from Google. As long as you are on your employer payroll, you should try your best to act in the best interests of that company. References: Doyle, C. (2016). Thank you, very informative. Pani definitely knew what he was doing. He most definitely acted unethically as he did the wrong thing from just about any perspective one wishes to choose.
