Which does protect the interest and right of those individuals with disabilities to be able to be incorporated in activities and programs that receives federal funds and federal financial assistance. It further states that despite of a child or an individual being in a position of disability they should not be denied benefits or excluded / subjected to any form of discrimination form any activities or programs that are being funded through federal financial assistance. Therefore, it requires all district schools to provide Free Appropriate Public Education (FAPE) to every individual within the district jurisdiction who is disabled regardless of the severity and nature of the disability. Kids with disability does include those with thinking and learning differences. FAPE does require the school to provide education structures which are special to be able to meet the unique needs of the children. Therefore, FAPE is an important legal right to a disabled child that enables a parent partner with the school and be able to advocate for support and services which the child needs.
