There was one submission from a student that wrote about Jesus as their hero and attached a picture of the Last Supper. Your standard is to display all of your student™s work in the classroom, so what do you do in this situation? The aim of this paper is to discuss the legal issues of grading and displaying a student™s assignment that pertains religious material and how the First Amendment applies in this situation. Legal Issues and the First Amendment When it comes to cases of religion and education, educators must be sure to stay neutral in these situations. It cannot seem as though they are promoting religion or punishing students for expressing religion and beliefs. Giving a student a lower grade and choosing not to display the assignment could be considered discrimination and possibly a violation of their First Amendment Rights. The First Amendment of the U.S. Constitution implies that all citizens have the freedom of speech (Cornell Law School, n.d.). In the case Peck v. Baldwinsville Central School District, a kindergarten student™s handmade poster was not fully displayed due to religious images.
