Hardwick, the Supreme Court in a 5-4 ruling, agreed with the s... tate of Georgia and deemed the act of sodomy punishable. The majority of the judges deemed œhomosexual acts not protected under the constitution and therefore gave states like Georgia the authority to enforce crimes of sodomy under their state statutes. The decision of the Bowers v. Hardwick case was determined by the conservative beliefs on homosexuality, without saying as much was against the moral values of the country. However, if we compare this case with the teachings of A.L.G Hart and his theory of positivism, one can conclude that law and morality are not really connected. According to Hart, œthere is no logically necessary connection between law and coercion or between law and morality (Hart, 1994, pg. 110). Thus, in what he identified as œsoft positivism, Hart explains that the enforcement of laws is not based on the personal beliefs of the court, but rather on the individual circumstances surrounding the individual and the case (Hart, 1994). The court agreeing with the state of Georgia set the stage for the legal arguments to come because it said that the liberties of homosexuals would be different from that of heterosexuals and under our Constitution like it or not "all men are created equal".
