It was further protected with the Individuals with Disabilities Education Act (IDEA) (Clark, 2001). However, ethically speaking it is also important. FERPA and IDEA put the legal obligation on staff and faculty to maintain privacy, but ethically speaking, staff and faculty have an obligation to maintain confidentiality of all their students personal information in order to create a safe and trusted environment for students to learn. This essay will discuss the ethical and legal reasons of why school maintain confidentiality. Instructional Setting, Learners, and Content Area The instructional setting is a fifth-grade class at Garden Elementary in Venice, Florida. Garden Elementary is a Title-1 school with a total of 605 students in grades Kindergarten through fifth grades. There is a total of 120 fifth grade students in five separate classes. This class has 25 students. The class has access to a computer cart with enough Lenovo laptops for each student to utilize, as well as, a digital whiteboard for the teacher. The class is supported by one full time teacher and one part time teachers aide.
